Sodomy may be defined as sexual intercourse per anus between two males or a male with a female.

PRE-REQUISITE FOR EXAMINATION OF SODOMY:

• Requisition from the investigating police officer or the magistrate.
• The consent of the victim. If she is under twelve years or unsound of mind, written consent from his parents.
• Witnesses of consent
• Identification of the victim from the escorting police constable.
• Two different identification marks
• Three copies of passport size photos
• The presence of a male in attendance
• Day time

DIAGNOSIS OF FORCEFUL SODOMY

• History taking
• Signs of Struggle
• Marks of violence
• General Violence
• Local violence
• Examination of anal swab

HISTORY TAKING

• Personal Details of the victim
• Age, address, occupation, religion
• Name of parents
• Marital status etc.

STATEMENT OF SODOMY VICTIM

• Time, date and place of occurrence
• Number of assailants
• Position of the victim, circumstances of the incidence
• Use of fear and threat by weapon
• Usage of drugs
• Struggle history, Call or shout for help
• Violence History
• Pain, Bleeding
• Degree of penetration, ejaculation etc.
• Use of any lubricant
• Bath, defecation, change of cloth

FINDINGS ON GENERAL EXAMINATION OF STATEMENT OF SODOMY VICTIM

SIGNS OF STRUGGLE

Nature:-

• Abrasions (grazes, scratches), Bruises
• Lacerations (by the door handle, corner of the furniture, bed, fallen on the blunt object)
• Stab or incised wound may rarely be found, inflicted by sharp & and pointed object
• Fractures may cause head injury

Areas:-

• Posterior aspect of the thighs, legs, arms, back, buttocks, and scapular regions by sands, gravels, grasses, woods, hard surface etc., of the place
• The inner aspect of the thigh due to forceful apart of thighs
• Occipital area of the scalp

MARKS OF GENERAL VIOLENCE

Nature:-

• Scratch abrasions
• Bruises, slap marks, blow mark
• Bite marks & and suction marks
• Rarely lacerations
• Areas
• About the mouth and throat
• Lips and nose
• Breasts & nipples
• Abdomen
• Wrists and back of forearm & and hands
• The back of the leg and thigh

FINDINGS ON LOCAL EXAMINATION

• Anal muscles are found dilated, irritable, sensitive
• Tender to touch
• Digital examination may show a loss of elasticity and tone
• Hematoma is frequently seen around the anus
• Linear abrasion of varying degrees extending from the anal margin to the anus
• Bruise, even laceration of the anus may occur, depending on the age of the victim and the force of penetration applied.
• Anal sphincter tearing, anal prolapse, and anal fissure may occur.
• Blood and fecal matter stains may be found in cloth and local areas

HABITUAL PASSIVE AGENT OF SODOMY

• Shaving of the anal hair
• The skin about the anus is smooth & thickened
• The muscle of the anus loses its normal tone
• If pinched, it does not contract so rapidly
• Depression of the buttock towards the anus sometimes becomes Funnel-shaped.
• Dilatation and laxity of the anus
• There may be anal fissures, hemorrhoids & scars
• Presence of venereal disease
• Lateral buttock traction test (lb test)- +ve

ACCUSED ACTIVE AGENT

• Fecal matter or lubricant in the penis
• Peculiar smell of secretion of anal gland
• Abrasion in prepuce and glans present
• Tearing of fraenulum
• Blood and seminal stain
• Presence of venereal disease
• Marks of struggle on the body

HABITUAL ACTIVE AGENT OF SODOMY

• Penis is elongated
• Twisted urethra
• Constricted at some distance from the glans
